1. ORGANIZER OF THE TRAINING OR EVENT

1. The organizer of the training and events (hereinafter: "event") to which these regulations apply is the company Operivo Sp. z o.o. (hereinafter: "Operivo" or "Organizer") based in Warsaw, Aleja Jana Pawła II 27, 00-867 Warsaw, KRS 0001186818.

 

2. REGISTRATION OF PARTICIPATION

1. To register for the event, you need to fill out a paper or electronic form and send a scanned document electronically to the contact details provided on the Operivo website or fill out the online form available on the Operivo site (the form does not require the orderer's signature and is equivalent to acceptance of these regulations).

2. Registration for participation in the event is equivalent to the Orderer accepting the terms of participation in the Event, resulting from the order and these General Terms.

3. The Orderer may designate a person registering more than one Participant if the internal organizational regulations of the Registrant allow it and are in accordance with generally applicable regulations regarding the protection of personal data. Operivo does not verify the processes on the Registrant's side and their compliance with regulations.

 

3. ENTRY ON THE PARTICIPANTS' LIST

1. Within 5 business days of delivering the registration form to the Organizer, the Orderer will receive confirmation of the Participant's entry on the event list via email – Confirmation of participation in the event.

2. A binding agreement for the provision of training services is concluded at the moment the Organizer confirms that the event will take place and the Registrant has received confirmation of participation in the Event.

3. After submitting the registration, but no later than 10 days before the event date, the Orderer will receive detailed information regarding participation in the event.

4. The number of places at events is limited. The order of incoming registrations determines participation.

5. Operivo has the right to refuse to enter the Participant or Participants on the list without giving any reason. Lack of confirmation of Participant registration means that they have not been added to the Participants' list for the event.

 

4. EVENT PRICES AND PAYMENT TERMS

1. Unless otherwise stated in the event description, a prerequisite for participation in the event is making a prepayment to the specified bank account or via available payment methods.

2. Unless otherwise agreed, the prepayment should be made no later than 7 days before the start of the event.

3. Unless otherwise stated in the event description, the prices provided are net prices, to which the statutory VAT tax at the applicable rate should be added.

4. The prices of open events organized only include the package specified in the event description. In particular, the prices of events typically do not cover the costs of accommodation, travel, or parking for Participants. The scope of closed events is determined individually.

 

5. CANCELLATION OF PARTICIPATION AND WITHDRAWAL FROM THE AGREEMENT

1. Cancellation of participation in the event must be reported to Operivo at least 10 business days before the event starts.

2. In the case of cancellation less than 10 business days before the event date, the registrant is obliged to cover the CHARGE NOTE issued for an amount equal to 80% of the net value of the event or events.

3. At any time before the event starts, the Registrant may designate another Participant from their organization or a related organization (organizationally or ownership-wise). The change of participant should be communicated in writing (via email) to an Operivo employee.

4. If during the sessions a Participant disrupts the course of the sessions or poses a threat to themselves or other Participants, Operivo has the right to refuse the Participant further participation in the event and in such a case, there is no right to a refund of the participation costs for that Participant.

5. At least 7 days before the planned start of the event, Operivo will finally confirm the realization of the event. The event may be canceled by Operivo, and in such a case, Participants will be notified, and prepaid funds will be refunded or allocated towards the participation fee in another OceanBerg event.

6. In the event of cancellation of the event by Operivo, Operivo is not liable for any costs incurred by Participants or their organizations related to the event.

7. If the Orderer is a Consumer within the meaning of the Civil Code, who entered into a contract for participation in the event at a distance (e.g., via an online form or by email), they have the right to withdraw from the contract without giving any reason within 14 days from the date of its conclusion, in accordance with the Consumer Rights Act of May 30, 2014.

8. According to Article 38(1)(1) of the Consumer Rights Act of May 30, 2014, the Consumer loses the right to withdraw from the contract if the service (participation in the event) has been fully performed with their explicit consent before the expiry of the 14-day period from the conclusion of the contract.

9. By registering for participation in the event and accepting these regulations, the Consumer agrees to the commencement of the service before the expiration of the withdrawal period and is aware that in such a case, they will lose the right to withdraw.

10. To exercise the right of withdrawal from the contract, the Consumer should submit a clear statement of withdrawal from the contract, sending it, for example, to the email address: europe@operivo.com or by mail to the address of Operivo's headquarters.

11. In the case of effective withdrawal from the contract, Operivo will refund all received payments without delay, no later than within 14 days from the day of receiving the Consumer's statement.

12. The right to withdraw from the contract does not apply in cases specified in Article 38 of the Consumer Rights Act, in particular, if:

1. the event (training service) has been fully performed with the explicit consent of the Consumer before the expiry of the withdrawal period,

2. the event starts before the expiry of the 14-day period, and the Consumer has been informed of the loss of the right to withdraw from the contract in such a case.

 

6. CHANGES TO THE EVENT DATE

1. Operivo Sp. z o.o. reserves the right to change the event date if its organization is not possible or business justified on the original date.

2. If the new date is not accepted, the Orderer has the right to withdraw from the event and a refund of the payments made.

3. If anything disrupts the realization of the event, Operivo will make every effort to continue it after the applied break. Any events realized in at least 70% of the time or content program are considered fully realized.

 

7. CERTIFICATE OF COMPLETION OF THE EVENT

1. The description of the event may include information about issuing participation or completion certificates. Certificates, unless otherwise stated in the description, cannot be treated as professional qualifications or certificates formally required by law.

2. The condition for obtaining a certificate of completion of the event is participation in all days of the event in at least 80% of the sessions.

 

8. ADDITIONAL INFORMATION

1. Materials made available to Participants during the event are protected by copyright. The Orderer and/or Participant has the right to use them only within the framework of allowed personal use. Copying, duplicating, or distributing these materials infringes property rights to these materials and may result in claims against the Participant and the organization registering them for the event.

2. Participants are entitled to share fragmentary materials from the event in photos and posts on social media: up to 3 slides, up to 30 seconds of recording.

3. Events take place at a location indicated by the Organizer depending on the type of event. Participants of the events will be informed about the location of the event before it starts.

4. The Organizer reserves the right to conduct inspections of the event's course by employees of the company and authorized external units.

 

9. PERSONAL DATA PROTECTION

1. The administrator of the personal data of the Orderer and Participants is Operivo, and all basic regulations regarding personal data are included in Operivo's policy: link >>.

2. During the event, the Organizer or companies designated for this purpose may register the event and take photographs. The content captured in this way may include the image of individual Participants and be published in the Organizer's materials and on social media for promotional or commercial purposes, of which each Participant has been informed in this regulation. In case of lack of consent to the publication of their image, the Participant may submit such a request to the Organizer. The Participant has the right to object to the processing of their image at any time by sending an email to the Organizer's address.

3. The Registrant undertakes the informational obligation resulting from current legal regulations to inform Participants of the event, whose personal data are being processed, as well as their right to access their personal data, request their correction, or deletion.

 

10. GENERAL

1. The Registrant undertakes to inform the Participants of the event about the content of these regulations.
